Donald J. Scialabba

Donald J. Scialabba is a member of the firm's Litigation Department and he has 30 years of experience in litigation, concentrating in the defense of physicians, hospitals, and medical facilities.  He has represented physicians and medical institutions in trials conducted in the New York Supreme Court in all counties of the New York metropolitan area and the Hudson Valley, as well as in the United States District Courts for the Southern and Eastern Districts of New York. 

Representative matters include:

• Successful in winning our motion for summary judgment, dismissing our OB/GYN physician-client's case in which plaintiff claimed that the infant plaintiff sustained Erb's Palsy from an improper delivery.
• Obtained a discontinuance at the time trial was scheduled to begin: Our client, a family practitioner, was accused of not warning plaintiff of the risk of injury of undergoing dental extractions after receiving bisphosphonate therapy for osteoporosis resulting from chemo therapy for prostate cancer.  It was our position that the codefendant dentist had the responsibility to warn plaintiff.  Codefendant settled with plaintiff and then discontinued against our client.
• Achieved dismissal prior to trial:  Plaintiff claimed that our dentist-client damaged her teeth while he administered anesthesia during her surgery.  Plaintiff was not ready to proceed to trial on the scheduled date and asked for an adjournment.  On our motion to proceed, the judge granted our request and dismissed the case. 

Don is also experienced in product liability, general liability and mass tort litigaton such as Asbestos, DES and DTP in which he represented major pharmaceutical manufactureers in cases brought in both state and federal courts throughout the northeastern United States.
